Terms and Conditions
This Agreement is made between Pat Cori Photography Inc (“Photographer”) and the undersigned Client(s) (“Client”). By booking services or using this website, the Client acknowledges and agrees to the following Terms and Conditions.
1. Scope of Services
Photographer agrees to provide professional photography services as outlined in the Client’s signed proposal, invoice, or contract. Deliverables, coverage hours, and event details will be defined in writing prior to the event. Photographer retains creative discretion regarding poses, lighting, composition, and editing style.
2. Retainer, Payment & Fees
A non-refundable retainer equal to 30% of the total collection price is required to secure the Client’s date. The remaining balance is due three (3) weeks prior to the event date. Payments not received by the due date may result in cancellation of services. Travel fees apply to events located more than 300 miles from Roanoke, Virginia. Additional charges may apply for extra hours, locations, or accommodations.
3. Rescheduling & Cancellation
If the Client needs to reschedule, the retainer may be transferred to a new date within twelve (12) months, subject to Photographer’s availability. If the Photographer is unavailable on the rescheduled date, the retainer will be forfeited. Cancellations must be made in writing, and all retainers are non-refundable.
4. Force Majeure & Failure to Perform
If the Photographer is unable to perform due to illness, accident, extreme weather, acts of God, transportation failure, or other causes beyond control, the Photographer will make reasonable efforts to reschedule or secure a qualified replacement photographer. If performance cannot be completed, all payments received (excluding the retainer) will be refunded. Liability shall be limited to a refund of monies paid.
5. Client Responsibilities
Client agrees to cooperate and communicate clearly with Photographer, provide reasonable access to venues, and ensure an environment free of hazards. Client shall confirm that photography is permitted at the venue and obtain any necessary permits. For weddings exceeding four (4) hours of coverage, Client agrees to provide a vendor meal and adequate break period.
6. Creative License
Photographer retains full creative control over the selection, editing, and delivery of images. Editing style is at the discretion of Photographer and reflects the brand’s signature aesthetic. RAW files remain the property of Photographer and will not be released.
7. Copyright & Usage Rights
All photographs created by Pat Cori Photography Inc are protected by U.S. copyright law. Photographer retains full copyright ownership of all images. Client is granted a personal use license to print, share, and display images for personal purposes. Commercial use or resale without written consent is prohibited.
Photographer reserves the right to use images for marketing, website, and portfolio purposes. Clients may opt out of marketing use by submitting a written request prior to the event.
8. Image Delivery & Backup Policy
Edited images will be delivered via a private online gallery within 8–12 weeks from the event date unless otherwise stated. The gallery will remain active for at least six (6) months. Client is responsible for downloading and backing up images before the expiration date. Photographer retains archived files for one (1) year from delivery and may delete them thereafter.
9. Substitute Photographer & Subcontractors
Photographer reserves the right to use assistants, second shooters, or subcontractors as necessary to fulfill services. In the rare event Photographer is unable to attend, a qualified replacement of similar style and experience will be provided.
10. Limitation of Liability
Photographer shall not be liable for circumstances beyond control such as weather, venue restrictions, schedule delays, or client non-cooperation. In any case, Photographer’s total liability shall not exceed the amount paid under the contract.
11. Indemnification
Client agrees to indemnify and hold harmless Pat Cori Photography Inc and its representatives from any and all claims, damages, or liabilities arising from Client’s actions, venue policies, or third-party involvement.
12. Dispute Resolution & Governing Law
In the event of a dispute, both parties agree to first attempt resolution through good-faith mediation prior to any legal action. This agreement shall be governed by and construed according to the laws of the Commonwealth of Virginia. If legal action is required, the prevailing party shall be entitled to recover reasonable attorney fees and costs.
13. Severability & Entire Agreement
If any part of this agreement is found invalid or unenforceable, the remainder shall continue in full force. Failure to enforce any term shall not waive Photographer’s rights. This document, along with the signed proposal or invoice, constitutes the entire agreement between the parties.
14. Acceptance
By signing the agreement, paying the retainer, or confirming services in writing, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
